Case opened against pesticide producer for death of Gironde viticulture.

Pesticides : ouverture d’une enquête préliminaire après la mort d’un viticulteur de Gironde.

Une enquête préliminaire a été ouverte le 27 avril après la plainte déposée par la famille d’un viticulteur du Bordelais, décédé d’une maladie liée à l’utilisation de pesticides. Des investigations vont être menées. Une première victoire pour la famille de la victime, en particulier pour sa fille, Valérie Murat, qui se lance dans une longue bataille judiciaire.

A preliminary investigation was opened on 27th April after a complaint was lodged by a Bordeaux wine grower’s family, who died of an illness associated with the use of pesticides. The case has produced a first victory for the victim’s family, in particular for his daughter, Valerie Murat, who has thrown herself into a long legal battle.

C’est une première en France : une enquête préliminaire a été ouverte après la plainte déposée par la famille d’un vitculteur du bordelais, décédé d’une maladie liée à l’utilisation de pesticides, uneplainte contre X pour homicide involontaire, tromperie et omission de porter secours. La plainte a été déposée le 27 avril dernier devant le Pôle de santé publique du Tribunal de Grand Instance de Paris. Le procureur a décidé d’y donner suite. Il a donc ordonné l’ouverture d’une enquête préliminaire.

It is the first in France: a preliminary investigation opened after a complaint by the wine growers family of involuntary homicide, by deception and the omission of sufficient safety warnings. The case was lodged before the Office of Public Health. The DPP decided to follow up to the High Court in Paris with the preliminary hearing.

James Bernard Murat était viticulteur à Pujols, au Sud de Castillon-la-Bataille dans l’Entre deux Mers. Il est mort en décembre 2012 d’un cancer des bronches et des poumons, dont le caractère professionnel, lié à l’utilisation d’arsénite de sodium, avait été reconnu en février 2011. Selon sa fille, il a utilisé ce produit pendant 42 ans, de 1958 à 2000, pour traiter ses vignes contre l’esca, une maladie due à des champignons parasites, sans jamais avoir été alerté sur la toxicité de ce produit pour sa santé.

James Bernard Murat was a wine grower in Pujols, Sud de Castillon-la-Bataille in  the Entre deux Mers. He died of cancer of the bronchus and lungs in December 2012, identified professionally, by the use of sodium arsenite in February 2011. According to his daughter he used the product for 42 years, from 1958 to 2000, to treat his vines against esca, contracted via parasitic mushrooms, without ever being alerted about the toxicity of the product to his health.

It's next staging was in the one act circuit is in Cavan, at Maudebawn on Sat 10 Nov 2012. Then it was performed in the Bray, Co.Wicklow at the very popular one act festival in January 2013. Next play is FEAR. A dark tale about revenge on the cruel death of two pensioners by young thugs. Neighbours hatch a devious and dangerous plan to exact old-style revenge. Bill is a member of the Drama League of Ireland and his plays have been critically vetted and certified as original pieces of work by the DLI. Another literary project is that of commemoration of an aircraft crash on Djouce mountain in Wicklow in 1946. Bill wrote articles for the 50th, 60th and most recently the 70th anniversary, (12 Aug 2016) all were published in the Wicklow Times and ensured the survivors of the crash, all French Girl Guides, were not forgotten. But mostly this site gives a more general European and specific French slant on popular and not so popular articles of French news, translated to English by the author. Each article is translated on a paragraph by paragraph basis so easy to read in either language and even possible to improve either language by comparison of the short English and French paragraphs. Amusez vous bien. The author is currently writing an easy to read technical aviation book centered around the Fokker 50. Another interest is that dealt with in another of Bill's websites www.realnamara.net, a Statue of the mother of God, Mary. It was erected in 1972 in Dublin, at the end of the Bull Wall near Clontarf, and my grandfather William Nelson, was the main instigator of that project.
