L’octogénaire Cornelius Gurlitt, chez qui 1.406 oeuvres d’art avaient été retrouvées en 2012, a conclu un accord ce lundi avec l’Etat allemand. Selon cet accord, il s’engage à restituer à d’éventuels ayants droit les oeuvres qui auraient été spoliées par les nazis, et s’est donné un an pour réussir.

The 80 year old, in whose house 1,406 works of art were recovered in 2012, has concluded an agreement on Monday with the German state. According to arrangement, he is to return to the legal entities (rightful party) the that which was dispoiled by the Nazis, et he has one year to succeed in this task.

Il y a encore quelques mois, Cornelius Gurlitt réclamait le retour de ses 1.406 oeuvres d’art, saisies par les autorités allemandes en 2012. La presse allemande avait dévoilé l’affaire un an plus tard, en novembre 2013, et révélait alors que la plupart des tableaux et autres chefs-d’oeuvre étaient conservés dans un appartement de Munich, au milieu des ordures.

There are already several months passed, where Gurlitt has claimed the return of his 1,406 works of art, recorded by the German authorities in 2012. The German press unveiled the affair a year later, in November 2013, and revealed then that most of the paintings and other masterpieces were held in an apartment in Munich, in the middle of a mess of waste.

Mais, depuis fin mars, l’octogénaire a fait machine arrière, revenant en partie sur ses déclarations et s’engageant à restituer certaines des oeuvres d’art, dont des Chagall, Matisse, Picasso, Renoir ou Gauguin, aux héritiers de leurs propriétaires. Ce lundi, l’accord qu’il a conclu avec le ministère fédéral de la Culture et le ministère bavarois de la Justice a été officialisé.

But, since the end of March, the octogenarian has taken a step back, going back on his agreement to return concerning certain works of art, including Chagall, Matisse, Picasso, Renoir and Gauguin, to their inheritors. On Monday, however the accord which was concluded with the Federal Minter of Culture and the Bavarian Mister of Justice was officially recognised.  

Un délai d’un an pour retrouver des ayants droit (Delay in finding the legal owners)

Selon les termes de cet accord, Cornelius Gurlitt se dit notamment prêt à respecter la “déclaration de Washington” de 1998, signée par l’Allemagne, dans laquelle 44 Etats s’engagent à retrouver et restituer l’art volé par les nazis. Il confie aux autorités allemandes la charge de centraliser les recherches sur les éventuels ayants droit des oeuvres retrouvées chez lui.

According to the terms of the accord, Gurlitt has said he is ready to respect the “1998 Washington Declaration”, signed by Germany, in which 44 States are engaged to find and return stolen Nazi art. It gives the German authorities the central charge of the search of the legal owners of the art works found in Gurlitt’s possession.

“Pour l’essentiel, la taskforce a souhaité conduire dans le délai d’une année les recherches sur la provenance des oeuvres et aboutir“, souligne le communiqué, précisant: “les oeuvres d’art pour lesquelles la recherche de provenance ne sera pas achevée dans ce délai, seront rendues à M. Gurlitt“.

“Essentially the task force has a year to succeed in the search for the original source of the art” the communique states, precisely: “if the the original source is not found within the time-frame, they will be returned to Gurlitt.”

“Avec cet accord désormais conclu, nous sommes parvenus à établir les bases nécessaires pour trouver des solutions justes et équitables, notamment par le biais de restitutions“, s’est félicitée la ministre fédérale de la Culture, Monika Grütter, citée dans le communiqué.

“With this accord already concluded, we are reaching to establish the necessary bases to find just and equitable solutions, notably by the restitution means.”, said an excited Federal Minister for Culture, Monika Grutter, in a communique.

Cornelius Gurlitt, fils d’un marchand d’art aux accointances connues avec des responsables nazis, possédait, outre les 1.406 oeuvres retrouvées, 238 oeuvres dont 39 huiles sur toile et des aquarelles signées, là encore de noms prestigieux de l’histoire de l’art. Ces dernières étaient entreposées dans une maison qu’il possède à Salzbourg en Autriche.

Gurlitt, the son of an art merchant with acquaintances among high ranking Nazis, possessed, besides the 1,406 works recovered, 238 works including 39 oils on canvass and signed water colours, again prestigious names in the history of art. These last ones were placed in house he owned at Salzburg in Austria.

Après la révélation de cette affaire, l’Etat allemand a lancé en novembre un site internet (www.lostart.de) pour aider les experts à retrouver des oeuvres d’art volées par les nazis.

After the revelation of this affair, the German state, in November launched an internet site (www.lostart.de)  to help experts recover Nazi stolen works of art.
